Spill Prevention Control and Countermeasures Plan (SPCC)

The SPCC regulation now requires that facilities with aggregate aboveground oil storage capacity of 1,320 gallons or greater, including 55 gallon drums, have systems capable of holding the maximum volume of fuel in their tanks in the event of a spill. Your facility may require an SPCC is you have large storage in underground storage tanks.

In 2002 the Environmental Protection Agency (EPA) amended the Oil Pollution Prevention regulation at Title 40 of Code of Federal Regulations, Part 112, (40, CFR 112). This regulation incorporated revisions in 1991, 1993, and 1997 often referred to as the Spill Prevention, Control and Countermeasures (SPCC) regulations. These changes to the regulation include not only a change in the oil storage capacity but also included replacing the word “should” with “shall.” Now instead of spill response plans and containment capabilities merely being a recommendation, they are a requirement. Also, if you have had 2 or more discharges in a year, there are additional requirement.

Facilities (other than farms) operating: Must:
Before 8/16/02 Maintain the facility's existing Plan. Amend and implement the Plan no later than 10/31/07.
Between 8/16/02 - 10/31/07 Prepare and implement Plan no later than 10/31/07.
After 10/31/07 Prepare and implement Plan before starting operations.

Stormwater Pollution Plans

The federal stormwater program presently requires stormwater permit, National Pollutant Discharge Elimination System (NPDES) for the following types of facilities:

  • A facility whose Standard Industrial Classification (SIC) Code is listed in one of the 11 Categories of “Storm Water Discharges Associated with Industrial Activity” as defined in federal regulations 40 CFR 122.26(b)(14)(i)-(xi).
  • Operators of municipal separate storm sewer systems (MS4) located in "urbanized areas" as delineated by the Bureau of the Census,
  • Operators of construction activity that disturbs 1 or more acres of land; construction sites less than 1 acre are covered if part of a larger plan of development.

    PLEASE NOTE: Your facility may qualify for a “No Exposure” status. Please contact BPE to discuss.
    As a requirement of the stormwater permit, a facility is required to create a Stormwater Pollution Prevention Plan (SPPP) in order to minimize the impact of industrial activities on stormwater. Stormwater sampling may also be required. Please contact BPE to determine if you facility falls under NPDES permitting.
